Flo's Side of Lawsuit Against W. Saylor and Rofkin

I am unable to get to the courthouse to retrieve the response in person.

Thus, I must use the on-line request process to get it.  This should take about a week.  I have initiated that process.

Oh my god they really don't digitize the files. Mostly surprised because I learned this week that Dallas County does.

You can see on-line which docs have been filed. Then you fill out an on-line form indicating which docs you want. They then scan them and send via PDF attached to an email. You also must pay a fee.

Takes 5-7 business days.

I assume Flo is their technical adviser.

I added a link to my original post in this thread that takes you to Willie and Rofkin's responses.  The court responded rather quickly to my request this time.  No word yet if the hearing that was scheduled for today is really happening or not.

Most interesting part of the responses is Willie and Rofkin have different attorneys, but both filed the same boiler plate responses.  Rofkin's is a noted "Super Lawyer" in TX.  Willie's, well, isn't

Rokfin's lawyer is John Reenan father of NC State's Nick Reenan.

Unless there is just some description of his reputation, "super lawyer" is likely one of a multitude of designations that you essentially can pay for, not an actual designation of skill.  Not that Mr. Reenan isn't an excellent attorney, I'm sure.

SuperLawyer doesn't mean much but 25 years as a litigator at least means something, even if his specialty appears to be insurance litigation. Willie's lawyer doesn't have a website as far as I can tell and appears to be primarily a tax attorney. If I were him I'd have copied off of Reenan's paper too.

The boilerplate responses, for non-lawyers, are what you do when you aren't trying to run up legal bills, show off or grandstand. Federal court practice typically involves a more specific response but a general denial is fine in a lot of state courts. I also wouldn't take all of the defenses entirely literally; they are often inserted as rights-reserving placeholders.

The hearing did occur today.

Trying to get a transcript.

I'd be surprised if it were anything more interesting than scheduling or a referral to mediation but fireworks would be interesting.

Not a total coincidence on the wrestling connection: Reenan's law firm bio says he is the chair of Texas's USA Wrestling affiliate. I suspect the Floreanis have known him for a while.

Travis County wants $197 for a transcript of yesterday's proceedings.

Curious to know what happened, but not $197 curious.

If someone wants to set up a GoFundMe drive to raise the money, I will donate $37.37, that's my limit.

Interesting.  Some states require, for the granting of a TRO, that the moving party (Flo in this case) show they have a reasonable likelihood of success.  It does nto appear from a quick review of Texas' Rules of Civil Procedure that showing is required, only a showing that "unless it clearly appears from specific facts shown by affidavit or by the verified complaint that immediate and irreparable injury, loss, or damage will result to the applicant before notice can be served and a hearing had thereon."

I'm sure it's relatively boring to non-lawyers, and no fun for Willie at all, but I'm enjoying the melding of my two worlds.

You clearly aren't the only one interested.  This thread has only been out there there for 10 days and is already in the top 25 pages of threads (out of 600) sorted by most views.

There is an odd dynamic at play here.  Flo is despised by many due to their technical ineptness, horrible customer Service, pricing model and never ending billing errors.  On the other hand, Willie was their poster boy for years and often takes an arrogant and abrasive approach with people.  On the flip side, Flo has enabled live content (despite its warts) that we never had before.  And Willie, despite his arrogance, has contributed to Flo's success.

Many angles of interest on this one.

Don't forget freestyle, this weekend is one of the biggest of the year for that.

Does Willie cover much freestyle? (I honestly don't know).   I know he also does a lot of HS stuff which I think there isn't a ton of during the holidays.

according to willies twitter, flo got a temporary restraining order on him. he cannot cover wrestling for two weeks

Does that mean we get two weeks of stripping?

I'm only still a Flo subscriber cause Willie fixed an issue couple years ago.  When I signed up this last year (expires mid Jan 20) Willie was still part of Flo so feel I've paid for the stripping if in the next couple weeks.

Perhaps someone who actually uses Twitter could ask for a friend?  ;)

The granting of the TRO does not bode well for him.  In most instances the 2 weeks is to shut him down temporarily if Flo has shown enough.  He would in many states get another crack at a preliminary injunction hearing.  That 2nd hearing usually is to determine if the prohibition stays in place longer.

His flippant comments would seem, at least to me, some recognition that the immediate future doesn’t look great.

I don’t care because I haven’t followed him or think he adds much to my fandom.
